Please read them carefully. You agree that all notices, disclosures, and agreements provided electronically satisfy any legal requirement for written communication.

All digital material on this site—including text, graphics, logos, product imagery, site code, and downloadable media—is the exclusive property of Portus or its licensing partners and is protected under Australian and international copyright laws.

• Usage Restrictions: Images, designs, and brand elements owned by Portus represent our corporate identity. They may not be reproduced, copied, edited, or distributed without express prior written approval from Portus.

• Prohibited Modifications: Approved users must display media in its original format. Altering, cropping, or misrepresenting Portus products in marketing materials, online listings, or blogs is strictly prohibited and constitutes an infringement of our intellectual property.

• Revocation: Portus reserves the right to revoke media permissions at any time.

License & Site Access

Portus grants you a limited, non-exclusive, and revocable license to access and make personal use of this website.

This license does not permit you to:

• Collect customer details or employ data-mining, scrapers, or extraction tools.

User Accounts & Responsibilities

If you create an account with Portus, you are responsible for maintaining the security of your login details and restricting unauthorized access to your account. Portus sells products to adults capable of completing transactions with an authorized payment method. Minors under 18 may only use Portus with parent or guardian supervision. Portus reserves the right to refuse service, edit content, or cancel orders at its discretion.

Reviews, Comments & Submissions

Visitors may submit feedback, product reviews, or suggestions provided the content is lawful, respectful, non-defamatory, and free of malware or commercial spam.

By submitting content to Portus, you grant us a non-exclusive, royalty-free, perpetual, and worldwide right to use, publish, and adapt that material. You warrant that you own or control the rights to submitted material and agree to indemnify Portus against any claims arising from content you supply.

Orders, Pricing & Sales Tax (GST)

• GST: All applicable Goods and Services Tax (GST) will automatically be applied to orders delivered within Australia. Customers are responsible for any external import duties or taxes for non-Australian destinations.

• Risk of Loss: Products purchased from Portus are fulfilled via third-party freight carriers. Title and risk of loss pass to you upon delivery to the carrier.

Product Specifications & Pre-Installation Guidelines

• Nominal Dimensions: All product dimensions are nominal (measured in millimeters) and subject to standard manufacturing tolerances. Portus reserves the right to adjust specifications without notice.

• Site Preparation Warning:

   

  IMPORTANT: DO NOT drill, cut cabinetry, or rough-in plumbing/electrical connections prior to physically receiving your Portus items. Portus is not responsible for installation errors or trade costs resulting from pre-installation work carried out before physical delivery.

• Image Accuracy: Lifestyle images are illustrative. Optional accessories or custom elements shown may not be included with standard products.

Shipping & Delivery

Delivery dates provided by Portus are estimates. While we aim for prompt dispatch, Portus is not liable for indirect costs or damages resulting from delivery delays caused by logistics partners or external factors.

Returns & Claims Policy

Damaged or Short Delivered Goods

Claims for damaged products or order shortages must be submitted in writing within three (3) business days of delivery. Photos or video evidence must accompany all damage reports.

Standard Returns & Restocking Fees

Products are generally sold on a non-return basis unless incorrect, faulty, or non-compliant with Australian Consumer Law.

If Portus accepts a return for reason of customer change of mind or ordering error:

• The item must be uninstalled, in its original, saleable packaging.

• The return must be pre-authorized by Portus, at the customer's transport expense.

• A 20% restocking fee will apply to cover handling and re-processing.

Installed Products & Warranty

Once an item is installed, standard return policies no longer apply. Any subsequent faults are governed by the Portus Express Warranty and Australian Consumer Law.

Disclaimer of Warranties & Limitation of Liability

This site and all materials, products, and services included are provided by Portus on an "AS IS" and "AS AVAILABLE" basis unless explicitly stated otherwise in writing.

To the fullest extent permitted by law, Portus disclaims all implied warranties including merchantability and fitness for a particular purpose. Portus will not be liable for indirect, incidental, or consequential damages resulting from the use of our products or website.

Where Australian Consumer Law implies guarantees that cannot be excluded, Portus's liability is strictly limited to:

• The replacement of the goods or supply of equivalent goods;

• The repair of the goods; or

• The refund of the purchase price.

Governing Law & Dispute Resolution

These terms are governed by the laws of Australia and the state of New South Wales. Any dispute relating to your interaction with Portus or purchases made shall be subject to confidential arbitration in NSW, except where intellectual property rights are threatened, in which case Portus may seek injunctive relief in any competent Australian court.
